Permit thresholds and foundation choice for small outbuildings

A shed a few square feet over the local limit is a different project, legally, than one just under it. The line is set in a model code most homeowners never read, and the foundation underneath the shed answers to the same frost-line physics as a fence post.

01 — The model code behind the square-footage rule

200 square feet is the reference number, not a guarantee

The International Residential Code, Section R105.2, exempts one-story detached accessory structures used as tool and storage sheds, playhouses, and similar uses from a building permit, provided the floor area does not exceed a set limit. Most current jurisdictions that adopt the IRC use 200 square feet as that limit, after a 2007 code change raised it from an earlier 120-square-foot threshold.

This is a model code, not a national law. Individual states, counties, and cities adopt the IRC with local amendments, and some jurisdictions still enforce the older 120-square-foot line, use an entirely different number, or exempt sheds only outside designated growth areas. Confirming the actual number with the local building department before designing a structure is the only reliable way to know which threshold applies.

The exemption text itself includes an important qualifier: exemption from permit requirements does not authorize work that violates the code or any other law or ordinance. A shed under the square-footage threshold can still need to meet structural, setback, and zoning rules even without a permit application.

The 2007 change from 120 to 200 square feet came from a straightforward observation during the code development process: common manufactured storage sheds regularly exceeded 120 square feet but rarely exceeded 200, so the older threshold was forcing a permit review on a large share of ordinary prefabricated sheds that rarely produced any actual structural issue.

02 — Why permit-exempt does not mean rule-exempt

Zoning, setbacks, and utilities are governed separately from the permit question

A structure small enough to skip the building permit process is still subject to zoning ordinances that control where it can sit on a lot, commonly a required setback distance from property lines, easements, and the primary residence. These setback distances vary by jurisdiction and are enforced separately from the building permit exemption.

Adding electrical, plumbing, or mechanical systems to a shed changes the calculation regardless of floor area. A structure with wiring or plumbing typically requires the relevant trade permit even when the building itself falls under the size exemption, since electrical and plumbing work carries its own inspection requirements independent of the structure's footprint.

Height is a separate variable some jurisdictions cap independently of floor area. A structure that stays under the square-footage limit but exceeds a local height cap, often somewhere between 10 and 15 feet at the wall or eave, can trigger permit requirements the floor-area exemption alone would not.

Some jurisdictions also count total accessory structure area across a property rather than evaluating each shed individually. A homeowner who already has a detached garage and a workshop can find a new, modestly sized shed pushed over the exempt threshold once its footprint is added to what already exists on the lot, which makes checking the cumulative limit worth doing before assuming a single small structure is automatically exempt.

03 — The frost line decides the foundation question

The same physics that lifts a shallow fence post lifts a shallow shed foundation

Frost heave, the upward movement of soil as the water inside it freezes and expands, is a well-documented seasonal process tracked by NOAA's climate research. A foundation sitting above the local frost depth experiences the same repeated seasonal push a fence footing does, which over several winters can tilt or crack a foundation set too shallow.

This is the reason foundations for small structures split into two broad categories. An on-grade foundation, gravel pad, skids, or deck blocks resting on the surface, does not resist frost heave and is generally appropriate only where frost depth is minimal or the structure is small enough that some seasonal movement is tolerable. A frost-proof foundation extends footings or piers below the local frost depth specifically to avoid that movement, the same principle behind a properly set fence post.

Local frost depth is not a fixed national number. It ranges from essentially zero in parts of the Gulf Coast to several feet in the northern states, which means the foundation type that works well for a shed in one region can be structurally inadequate for the identical shed a few states north.

04 — Matching foundation to structure and ground contact

Wood in ground contact needs the same rating a fence post does

A skid foundation places pressure-treated timbers in direct or near-direct contact with the ground, the same exposure a fence post faces. The American Wood Protection Association's Use Category System applies here identically: skids resting on or near grade need lumber rated for ground contact, Use Category UC4A at minimum, not the lighter above-ground rating sold for framing and decking.

Gravel underneath a skid or timber-frame foundation is not decorative. A layer of compacted gravel raises the wood slightly above standing water and improves drainage away from the base, the same drainage principle used at the bottom of a properly dug fence post hole, and it meaningfully slows the moisture exposure that leads to rot at the point where wood meets soil.

A structure's intended permanence is worth deciding before foundation type, not after. A shed that might need to move to a different spot on the property favors skids or deck blocks, which can be lifted and relocated. A structure meant to stay put for decades, particularly one in a region with meaningful frost depth, is generally better served by a frost-proof foundation from the start rather than retrofitted later.
