New Millennium Concepts, Ltd. was incorporated in Texas in October 1998 and has operated continuously since. The company is headquartered in Arlington, Texas and distributes Berkey systems globally. Manufacturing has historically run through Berkey International, a related entity based in San Juan, Puerto Rico.
The Berkey system became one of the most discussed water filtration options in preparedness, homesteading, and health-conscious households over the following two decades. Its appeal is straightforward: no electricity, no plumbing connections, no ongoing subscription, and a filter lifespan that makes per-gallon cost among the lowest available in its category.
The brand's current situation is more complicated than it was two years ago. The EPA classified Black Berkey filter elements as pesticide devices under FIFRA in late 2022, triggering a stop-sale order that halted standalone element production. NMCL contests the classification and the case is before federal appellate courts as of June 2026. The company introduced the Phoenix Gravity New Millennium Edition filter elements in November 2025 as an endorsed alternative while the dispute is resolved. Phoenix elements carry NSF certification; Black Berkey elements do not. This page reflects that current state.

Honest Limitations
The EPA classified Black Berkey purification elements as pesticide devices under FIFRA in late 2022 and issued stop-sale orders that halted production. NMCL disputes the classification and the case is before federal appellate courts as of June 2026. Standalone Black Berkey replacement elements are not currently in production and pre-existing inventory has been depleted at authorized dealers. The Phoenix elements are available as an endorsed alternative while the dispute is pending. Anyone buying a Berkey system today should understand that replacement element availability is constrained, and that the situation may continue to evolve.
Original Black Berkey elements have no NSF product certification. Phoenix elements carry NSF 42 (aesthetic effects: taste, odor, chlorine) and NSF 372 (lead reduction). Neither Black Berkey nor Phoenix elements carry NSF 53 (health effects) or NSF P231 (microbiological purifiers). Independent lab tests show strong contaminant removal performance, but that testing is not conducted under ongoing NSF oversight. Competitors including ProOne and Clearly Filtered carry NSF 53 certification. Households with confirmed contamination concerns should factor this in.
A consumer class action filed in 2022 alleges that Berkey's performance claims for Black Berkey elements overstate actual filtration capability. The case has cleared early procedural hurdles and is in discovery as of early 2026. No final ruling or settlement has been announced. Gravity filtration is slow by design. The Big Berkey fills at roughly 1 gallon per hour under normal conditions. The unit is also large (over 19 inches tall with a stand) and requires counter or shelf space. For households accustomed to on-demand filtered water, keeping the lower chamber topped up is a habit rather than an inconvenience, but it is a habit that takes adjustment.
