The five-minute answer
The recipient comes before the crop plan.
University of Minnesota Extension's March 2026 donation guidance starts with the receiving food shelf: ask whether it accepts fresh produce, what people actually want, and when the organization can receive it. USDA school-garden guidance similarly tells gardens and nutrition programs to coordinate crop choices, quantity, harvest timing, product quality, food safety and delivery logistics before produce enters school meals.

The recipient agreement
Ask what the organization can distribute, not what the garden wants credit for growing.
Current Minnesota Extension guidance advises gardeners to contact the food shelf before planting or delivery, learn what produce people want, and check receiving hours because poor timing can turn good produce into spoilage. Iowa State's donation-garden toolkit similarly asks about distribution frequency, refrigeration space, packaging, delivery schedules and information the recipient needs.

Three donation pathways
A pantry, a school kitchen and a direct handout are not the same system.

Confirm fresh-produce policy, desired crops, delivery windows, quality, cold storage, containers and whether the organization has restrictions on cut, processed or home-preserved food.
School / institution
Formal food-service handoff
USDA advises schools to communicate growing/handling expectations, accept donations when nutrition staff are present, identify source/date, refrigerate when appropriate, inspect transportation and maintain traceability.
Direct distribution
Different legal and operating questions
A free produce table, community refrigerator or direct household giveaway can have different site, labeling, food-safety and liability questions. Do not assume the rules or federal liability protection are identical to donation through a nonprofit.
The procedure
A ten-step donation operating cycle.
Choose the recipient before committing crop space.
Identify a real contact, organization type and receiving location. Confirm that the recipient wants fresh garden produce this season. Record a backup recipient only after confirming its requirements too.
Write the Recipient Agreement Card.
Record desired/undesired crops, quantity range, days/times, quality standards, washing preference, containers, refrigeration, source/date records, transport expectations and who can accept the delivery. Review it before planting and again before peak harvest.
Plan useful crops and realistic quantities.
Use the recipient's preferences plus the garden's normal production reliability. A modest recurring supply that arrives usable is better than a single flood of zucchini or greens nobody can store. Use succession planting when a recipient wants steadier volume.
Prepare the harvest team and containers.
Follow the Harvest/Postharvest guide for clean hands, clean harvest tools, food-suitable containers and contamination controls. If a volunteer is ill, use the garden's food-handling illness rule and recipient expectations rather than treating donation harvesting as ordinary yard work.
Harvest to the agreed quality standard.
Donate food you would regard as usable food, not the garden's disposal pile. Reject rotten produce and produce directly contaminated by animal feces. Separate cosmetic imperfection from safety/decay. USDA school guidance tells nutrition programs to reject donated produce that does not meet program standards.
Protect quality between harvest and delivery.
Shade produce, minimize crushing, and use crop-specific cooling/storage. Do not automatically wash everything. Minnesota Extension's 2026 food-shelf guidance recommends brushing off dirt and specifically advises against washing highly perishable items such as berries or greens before donation because it can shorten shelf life. School/institutional recipients may have their own approved washing SOP.
Identify the donation.
At minimum, keep a garden record of crop, source/garden, harvest or delivery date, quantity and recipient. Add variety/harvesters/lot identity when the recipient requires it. USDA school traceability guidance specifically calls for product/variety, harvest date and persons involved in harvesting for school-garden produce.
Transport cleanly and arrive when someone can receive it.
Use a clean vehicle/covered cargo area separated from chemicals, trash and animals. USDA school guidance says community donations should be received when nutrition staff are present and recommends inspecting transport vehicles for cleanliness; a vehicle used to transport live animals should not transport fresh produce to the school.
Record acceptance, rejection and loss.
If produce is rejected, record the reason: wrong crop, too much, overmature, damaged, dirty container, temperature/holding issue, timing, undocumented source or another requirement. If the issue is a safety or temperature question, do not simply take the same lot to another organization without resolving the cause.
Close the loop before next season.
Ask what was useful, what spoiled, what ran out quickly, which crops were hard to distribute and whether delivery timing worked. Adjust crop mix, quantity, succession and delivery schedule. Donation pounds are an output measure, not proof that the system served recipients well.
Harvest and quality boundary
Donation is not a lower food-quality tier.
FDA consumer guidance distinguishes ordinary bruising from rot, while the Harvest/Postharvest specialist adds the community-garden contamination boundary. The receiving organization may apply stricter cosmetic or condition standards based on distribution and storage.

Traceability
Keep enough identity to answer “where did this come from?”
Traceability requirements depend on the receiving program. USDA's school guidance is explicit because school meal programs need to trace produce sources. A community pantry may have a simpler process.
Recommended NWS minimum: crop, garden/source, harvest/delivery date, quantity, recipient and contact person. This is a recordkeeping practice, not a claim of a national legal requirement.
USDA recommends recording product/variety, harvest date and all persons involved in harvesting school-garden produce; it also advises keeping different sources identifiable rather than commingling them.
A garden may create an internal code such as date + crop + harvest group so containers and the binder can be linked. Do not present the internal code as an FDA-required lot system unless the receiving program says so.
Periodically choose one donation and ask whether a steward can identify when it was harvested, where it went and who to contact. Schools may have formal mock-recall procedures.
School and institutional addendum
A school donation enters a food-service system.
USDA allows community produce donations to schools when they meet the program's acceptable condition and applicable state/local requirements. USDA advises communicating growing/handling expectations, accepting produce while nutrition staff are present, identifying source/date, refrigerating promptly when appropriate and keeping transportation clean.
Before the season
Meet the nutrition director. Ask what crops/quantity can enter meals, what standards apply, how delivery will be received and which records are required.
Before each delivery
Confirm staff are present. Keep source/date identity. Use clean transport and crop-appropriate temperature control. Do not commingle with another source if the school requires traceability.
Liability boundary
Federal protection is real, but it is not a permission slip to ignore food safety.
USDA's March 2026 FAQ explains that the Bill Emerson Good Samaritan Food Donation Act provides federal civil and criminal liability protections for certain donors, gleaners and nonprofit organizations when statutory criteria are met. Amendments enacted in 2023 expanded some protections.
The Act includes “persons and gleaners” donating in good faith to a nonprofit for ultimate distribution to needy individuals under the statutory conditions. USDA's definition of person is broad and includes organizations and associations, but whether a specific garden and transaction qualify is a legal fact question.
USDA says only specified “qualified direct donors” receive the Act's protection when donating directly to needy individuals at zero cost. Do not assume every community-garden produce table fits that category.
USDA states that the Act does not waive state or local health regulations and that protected donations must satisfy applicable quality and labeling standards unless the statute's specific reconditioning conditions are met.
Treat food safety, recipient standards and local health rules as operating requirements, not paperwork made unnecessary by the federal liability statute.

Failure diagnostics
Donation failure is usually a planning failure, not a generosity failure.
Large deliveries are repeatedly declined.
Likely cause: planting volume exceeds recipient capacity. Response: shrink/stagger planting and agree on a delivery range.
Produce arrives wilted.
Likely cause: field heat, delay or cold-chain mismatch. Response: harvest cooler when appropriate, shade promptly and coordinate holding/delivery.
Recipient throws away unfamiliar crops.
Likely cause: garden chose crops without recipient/community input. Response: revise crop plan based on what people actually use; add identification/preparation information only if recipient wants it.
Volunteers wash everything before delivery.
Likely cause: “cleaner looks better” replaced the approved postharvest procedure. Response: write recipient-specific wash/brush-off instructions on the harvest card.
Nobody can identify where a rejected box came from.
Likely cause: no donation record or containers commingled. Response: add a simple source/date/crop record and recipient-required identifiers.
Pounds donated rise while spoilage rises too.
Likely cause: output quantity became the goal instead of usable distribution. Response: track rejection/spoilage/recipient usefulness, not weight alone.
Stop conditions
Do not turn food donation into food disposal.

Common questions
Questions that keep generosity aligned with recipient capacity.
Should we grow the crops that produce the most pounds?
No. Grow what the recipient says people can use and what its storage/distribution system can handle. Total weight is not a substitute for usefulness.
Should donated produce be washed?
Ask the recipient. Some highly perishable crops store better unwashed until use, while an institution may have a formal receiving/washing SOP. Do not assume one national donation-washing rule.
Can we donate cut vegetables?
This guide centers whole raw produce. Cut produce enters a more controlled food-safety state, and many recipient/local rules differ. Only do it through an approved program procedure.
Can we donate home-canned or dehydrated garden food?
Do not assume so. Acceptance varies by state and recipient and is commonly more restrictive than whole produce. Verify before processing food for donation.
Does the Good Samaritan Act mean we cannot be sued?
No. USDA describes federal protections when statutory criteria are met, with exclusions and limits. The Act does not override state/local health regulations, and this page cannot determine whether a specific garden transaction qualifies.
What should we measure?
Track useful operational measures: accepted quantity, rejected/spoiled quantity, crops requested, delivery reliability and recipient feedback. Pounds can be recorded, but they should not become the only success measure.
