Nebraska lands in the Conditional band because a statewide average must absorb eastern river-bottom farmland, the Sandhills, and the arid Panhandle at once, and all three pull the picture in different directions. The number above hides a state whose eastern third combines productive loam soil, 30 inches or more of annual rainfall, mature agricultural infrastructure, and rural service towns that still function.

The condition is water governance. Nebraska's 23 Natural Resources Districts each set their own groundwater rules, and those rules can differ dramatically from one district to the next. A parcel in an eastern NRD with no allocation limits operates under fundamentally different terms than a parcel in a western NRD with annual pumping caps, well moratoria, and declining aquifer levels. Understanding which NRD a parcel falls in and what rules that district enforces is the single most important due-diligence step in a Nebraska land purchase.

The farm-value figure is a statewide agricultural benchmark from the USDA, useful for comparison across states. It is not the asking price for a five- or ten-acre homesite, and as the cost section below shows, it is not what a livable site actually costs.

Eastern Nebraska is where the state's self-reliance strengths line up most clearly for a household-scale operation: productive soil, adequate rainfall, functional service towns, and NRDs that generally have not needed to impose severe allocation limits. The legal sections below apply statewide, but the ground under your feet does not.

Nebraska's land-use authority is split three ways. The state sets water doctrine and certain agricultural frameworks. The 23 Natural Resources Districts govern groundwater. The county handles zoning, building, and septic. The most expensive mistake buyers make is treating the state line as the relevant boundary when the NRD boundary is the one that controls their water.

Many rural Nebraska counties have limited or no zoning outside incorporated areas. This means more freedom but less predictability. Before you commit, call the county planning office, the county health department, and your NRD about the specific parcel.

Water law

Nebraska runs a dual water-rights system.

Surface water follows one doctrine. Groundwater follows another. The institutions that manage them are different. Understanding which system applies to your parcel is the single most important piece of due diligence in a Nebraska land purchase.

Surface water: prior appropriation

Nebraska's surface water follows the prior appropriation doctrine: first in time, first in right (NE Constitution, Art. XV-4). The Nebraska Department of Natural Resources (DNR) administers surface water permits. During shortages, senior appropriators are served before junior ones. Appropriative surface water rights are real property rights attached to the land and can be transferred, leased, or used as collateral. Rights can be lost through non-use after a statutory period, typically five years. Any diversion of surface water for irrigation or other beneficial use requires a DNR permit regardless of volume.

Groundwater: correlative rights and NRDs

Groundwater follows a correlative rights framework: all landowners overlying an aquifer have a reasonable right to use groundwater beneath their land, subject to public management. Since 1975, the 23 Natural Resources Districts (NRDs) have held the legal authority to regulate groundwater. Each NRD operates under its own groundwater management plan with its own allocation limits, well spacing requirements, and permit procedures. Some NRDs impose annual pumping caps; others have placed moratoria on new wells. The rules that govern your well are set by whichever NRD your parcel falls in, and they vary significantly from district to district. Owning the land does not guarantee unrestricted pumping.

Wells

You must obtain a well permit from your NRD before drilling. A licensed well driller is required. Upon completion, the well is registered with the NDNR statewide database. New owners must file a notice of change of ownership with the NRD. Some NRDs require well spacing distances, and some have placed moratoria that prevent new irrigation wells entirely. Domestic wells below 50 gallons per minute are generally exempt from allocation limits but not from the NRD permit requirement. Test any well for bacteria, nitrate, and contaminants before you rely on it. Nitrate from agricultural runoff is a documented concern in many irrigated counties.

Rainwater

No state law prohibits rainwater collection, and the practice is encouraged by the University of Nebraska-Lincoln Extension and the City of Lincoln. The state residential code (Section P2912) governs nonpotable rainwater collection systems with requirements for approved roof materials, debris excluders, first-flush diverters, and storage tank placement. Water intended for drinking must be treated. Rainwater collection is practical for garden irrigation in eastern Nebraska but cannot offset the need for a well on any property that requires year-round water.

The Ogallala Aquifer and why it matters

Much of Nebraska sits over the Ogallala (High Plains) Aquifer, one of the largest underground water supplies in the world. In the eastern and central Sandhills, the aquifer is thick and well-recharged. In western Nebraska and the Republican River basin, decades of irrigation have drawn down levels significantly, and some NRDs have imposed strict allocation limits in response. The aquifer's condition at the parcel level affects well yield, irrigation capacity, and the long-term viability of agriculture on the property. Selling home-kitchen food

Nebraska has one of the most permissive cottage food frameworks in the Midwest. Under LB 262 (effective July 2024), there is no annual sales cap, registration with the Nebraska Department of Agriculture is free, and the allowed-food list expanded to include TCS (time and temperature controlled) foods like cheesecakes, cream pies, and buttercream. Non-TCS foods may be shipped within Nebraska. TCS foods must be delivered in person within two hours under temperature control.

A food safety course is required if you sell anywhere other than farmers markets. All labels must include the statement: "This food was prepared in a kitchen that is not subject to regulation and inspection by the regulatory authority and may contain allergens."

All sales must be direct from the producer to the end consumer. Wholesale, retail, and restaurant sales are not permitted under the cottage food exemption. Home-canned low-acid foods (vegetables, fish, meat) require a licensed facility. Neb. Rev. Stat. 81-2,280.

Right to farm

The Nebraska Right to Farm Act (Neb. Rev. Stat. 2-4401 to 2-4404, enacted 1982) protects farm operations from nuisance suits when the operation existed before a change in surrounding land use or occupancy. To qualify, the operation must be engaged in the commercial production of farm products on more than ten acres of land. The 2019 amendment (LB 227) added a two-year statute of limitations for nuisance claims against agricultural operations, meaning a nuisance action must be brought within two years of the operation giving rise to the claim. The law does not apply to operations that were a nuisance before the surrounding change, or to negligent, improper, or illegal operations.

Livestock and zoning

Rural Nebraska is deeply livestock-friendly. The state's cattle industry is the third largest in the country, and the infrastructure, feed supply, veterinary services, and processing capacity are established across most of the state. Chickens, goats, and bees are broadly permitted in agricultural-zoned areas. Many rural counties have no zoning outside incorporated areas, which means few formal restrictions on livestock but also no buffer from adjacent land uses. Incorporated towns and cities have their own ordinances governing backyard chickens, roosters, setbacks, and animal density. Confirm the specific rules for the exact parcel, whether through the county or the municipality.

Nebraska's soils divide into three broad bands. Eastern Nebraska has productive loam and silt loam deposited by wind (loess) and river systems. The Platte River valley has highly productive silt loam. The central Sandhills have deep, sandy, well-drained soils that are native grassland and poor for crops without irrigation but excellent for livestock. The Panhandle has clay loam with alkaline tendencies that requires lime management (or avoidance of lime) and careful water application.

Corn, soybeans, winter wheat, sorghum, dry beans, and sunflowers are all established commercial crops. The eastern growing season is long enough for a full warm-season garden. Season extension through high tunnels is practical across most of the state. The Panhandle's short season and high elevation favor cold-hardy crops and dryland wheat.

The University of Nebraska-Lincoln Extension operates county offices statewide with soil testing, Master Gardener programs, and region-specific growing guidance. The UNL Soil Health and Water Lab provides testing packages. Get a soil test before you plan a garden or pasture; the amendment strategy for eastern loam, Sandhills sand, and Panhandle alkaline clay are fundamentally different.

Hazards and insurance

Tornadoes and severe hail

Nebraska averages 57 tornadoes per year. The corridor from Grand Island through Omaha is the most active zone. The June 2014 Pilger tornadoes tracked side by side as simultaneous EF-4s and destroyed a small town. Nebraska is also one of the most hail-prone states in the country. Baseball-sized hail events hit central and eastern Nebraska multiple times per year, destroying crops, vehicles, and roofs in minutes. Storm-rated buildings and a tornado shelter are not optional on any Nebraska property.

Flooding and ice jams

The March 2019 "bomb cyclone" caused catastrophic flooding along the Platte, Elkhorn, Loup, and Niobrara rivers, killing three people and causing $1.4 billion in damage. Ice jams on the Missouri and Platte rivers can cause sudden flooding in late winter with no rainfall at all. Check FEMA flood maps before committing to any parcel near a watercourse, and factor flood insurance into the carrying cost.

Blizzards and extreme cold

Nebraska blizzards can be among the most dangerous in the Great Plains. I-80 and I-76 close multiple times per winter. Rural western households can be snowed in for days with no power and no road access. Wind chill in blizzard conditions reaches minus 40 degrees or lower. A backup heating source that does not depend on electricity is essential. Livestock need windbreaks, heated water, and adequate feed reserves to survive blizzard events.

Drought, heat, and wildfire

Western Nebraska faces persistent drought. The Republican River basin and the Panhandle have experienced severe multi-year droughts that triggered NRD allocation cuts. Ogallala Aquifer depletion affects irrigation capacity in parts of the west. Summer heat waves push temperatures above 100 degrees with high humidity in eastern Nebraska. The Sandhills and Panhandle carry wildfire risk in dry springs and falls, and grass fires on the open plains move fast.

Every hazard here ties back to a siting or insurance decision. Use the FEMA National Risk Index and FEMA Flood Map Service Center to check any parcel, and get an address-specific insurance quote before you sign.

True cost

The sticker price is the smallest number.

The USDA benchmark of $4,400 per acre is statewide agricultural land, moderate by Midwest standards. A raw parcel often needs a well, septic, driveway, power, a shelterbelt, and insurance before a household can live on it, which commonly adds tens of thousands of dollars beyond the purchase price.

Well and treatment

Well depth, yield, and water quality vary dramatically by region and NRD. Eastern wells are generally reliable at moderate depth. Sandhills wells can be shallow but may carry elevated natural minerals. Panhandle wells face lower yields and harder water. Nitrate from agricultural runoff contaminates private wells across many irrigated counties. Budget for the well, pump, pressure tank, and a treatment system appropriate to the water chemistry. Test before you buy, and test annually after.

Septic

Nebraska's on-site wastewater systems are regulated at the county level. A soil evaluation is required before installation. Sandy soils drain well but may not meet setback-to-groundwater requirements. Clay soils require engineered systems at higher cost. Make any purchase offer contingent on a passing soil evaluation. A failed test on a parcel without municipal sewer is a deal-breaker.

Shelterbelt and exposure

Nebraska's open plains offer no natural wind protection. A shelterbelt of trees on the north and west sides of a homesite reduces heating costs, protects livestock, and moderates wind speed across a garden. Establishing one takes years and costs money for trees, irrigation during establishment, and maintenance. Many existing shelterbelts on older properties have been removed. Factor this into any property that lacks mature windbreaks.

Power and storm readiness

Grid extension to a remote lot can cost thousands per pole. NPPD and local public power districts serve most rural areas. Storm outages from blizzards, tornadoes, and ice can last days. A backup generator or battery system is essential. Solar production is strong from May through September, limited through winter. Storm-rated roofing and impact-resistant windows are worth the investment in hail-prone areas.

Access and distance

Confirm legal frontage on a county or state road. Sandhills and Panhandle parcels may be accessed by minimum-maintenance roads that are not plowed in winter and may be impassable in mud season. Distance to hospitals, fire stations, and grocery stores is real in western Nebraska. Budget for fuel, vehicle maintenance, and travel time as recurring operating costs.

Taxes and insurance

Nebraska property taxes on agricultural land are assessed at 75% of actual value, which can be substantial in productive areas. Greenbelt special valuation offers additional relief for ag land with non-ag value influences. Homeowner's and crop insurance costs vary by location, hail zone, and flood zone. Get quotes before you close.

Agricultural land assessment and the greenbelt program

All agricultural land in Nebraska is assessed at 75 percent of its actual value for property tax purposes. This is a constitutional provision (Article VIII, Section 1(3)) that applies automatically to land classified as agricultural by the county assessor. No application is required for this base treatment.

The "greenbelt" special valuation (Neb. Rev. Stat. 77-1343 to 77-1380) provides additional relief for agricultural or horticultural land whose value has been inflated by non-agricultural development pressure. Under this program, qualifying land is assessed at 75 percent of its special value (what the land would be worth if available only for agricultural use) rather than 75 percent of its full market value. The land must be at least five contiguous acres and primarily devoted to agricultural or horticultural use. Application is through the county assessor using Form 456, and eligibility is determined annually as of January 1.

If the land loses its greenbelt qualification, the assessor applies the recapture valuation at actual value. The recapture provision was most active through 2008; check current status with the county assessor. The distinction between the base 75-percent assessment (which applies to all ag land) and the greenbelt special valuation (which applies only to ag land with non-ag value influences) matters when evaluating a parcel's tax burden.

Identify your NRD

Determine which of the 23 Natural Resources Districts the parcel falls in. Contact that NRD directly and ask about current groundwater allocation limits, well permit requirements, spacing rules, and whether a moratorium on new wells is in effect. This is the most important call you will make in a Nebraska land search. NRD boundaries follow river basins, not county lines.

Well water quality and yield

If the parcel has an existing well, test for bacteria, nitrate, and any contaminants documented in the area before closing. Check the NDNR Registered Well Database for the well's registration, depth, and capacity. If a new well is needed, confirm the NRD will issue a permit and understand expected depth and yield for the area.

Certified irrigated acres

If the parcel has irrigated cropland, confirm the number of certified irrigated acres, the associated water allocation, and whether those acres can be transferred with the land. In some NRDs, irrigated acres and their water allocation are tracked separately from the land title. Losing irrigation rights to an administrative error or a missed transfer filing can devastate a property's productive value.

Septic contingency

Make any purchase offer contingent on a passing soil evaluation and septic permit from the county. Sandy soils may drain too fast; clay soils may drain too slowly. High water tables in river valleys can complicate septic siting. A failed soil evaluation on a parcel without municipal sewer is a deal-breaker.

Zoning and county rules

Call the county planning office and confirm whether the county has a zoning ordinance and, if so, what the parcel is zoned for. Many rural Nebraska counties have no zoning outside incorporated areas. In those counties, confirm setback, building, and livestock rules at the county level. Check for any floodplain restrictions.

Flood zone and drainage

Check FEMA Flood Map Service Center for the parcel's flood zone designation. Platte Valley and Missouri Valley parcels carry real flood risk. Ice-jam flooding on the Platte and Missouri can occur suddenly in late winter with no rainfall. Factor flood insurance into the carrying cost.

Shelterbelt and wind exposure

Evaluate the property's wind protection. A mature shelterbelt on the north and west sides measurably reduces heating costs, protects livestock, and moderates wind across a garden. If the property lacks one, budget years and dollars to establish it. Ask about the local history of hail events and tornado activity.

Get homeowner's insurance, flood insurance, and (if relevant) crop insurance quotes before you close. Nebraska's hail, tornado, and flood exposure create insurance costs that vary dramatically by location. Distance from a fire station affects homeowner's rates. Hail-prone areas may need impact-resistant roofing to get reasonable coverage.

South Dakota has cheaper land and fewer tornadoes but a shorter season and less agricultural diversity. Iowa has richer soil and more rainfall but significantly higher land prices and less solar potential. Colorado's eastern plains are comparable in character but drier, and Colorado water law is more restrictive.

The question is whether Nebraska's combination of soil, aquifer, agricultural infrastructure, and cottage food freedom justifies the NRD complexity, the weather extremes, and the open-plains exposure. For a household that values productive cropland, established livestock infrastructure, and a permissive food-sales framework, and is willing to invest in storm-rated buildings and wind protection, eastern and central Nebraska competes well against any Great Plains state.
