A community garden is an organizational project with a horticultural outcome. The best first-season garden is not the one with the most beds. It is the one the community can legally use, safely cultivate, water, maintain and hand to the next group of leaders.
Organize
Define who the garden serves, build a working team and assign responsibilities that do not depend on one founder.
Evaluate
Compare candidate sites, verify the owner, investigate past uses, water, flood exposure, access and local land-use constraints.
Separate soil questions
Know the difference between fertility testing and environmental contaminant testing. A routine nutrient report is not a universal safety certificate.
Prove readiness
Reach a documented proceed, investigate, modify or stop decision before construction day.

Step 1 · People first
Know who will actually garden.
Before searching for lumber, ask who the garden is for. Families who need small plots, older adults, schoolchildren, apartment residents and a food-bank production garden can all need different locations, paths, bed designs, hours and management systems.
Answer four questions
- Who: Who expects to use the garden during an ordinary week?
- Why: Individual plots, communal production, education, gathering, donation, or a combination?
- Where: How far can intended gardeners realistically travel for watering and maintenance?
- How: Who will still be doing the maintenance after opening-day enthusiasm fades?
Evidence note
NC State Extension advises engaging intended gardeners from the beginning and notes that a garden designed by outsiders is less likely to be adopted and sustained. It also uses a committed group of at least five people as a practical benchmark for a substantial volunteer-led project. That is a planning benchmark, not a legal minimum.

One person can hold more than one function in a small project. The test is whether the garden can continue when a key person is unavailable.
Step 2 · Compare before committing
Find two or three candidate sites.
A vacant lot is not automatically a garden site. NC State recommends comparing several locations where possible so the team can judge convenience, secure tenure, water, sun, soil, drainage, zoning, materials access and community support.
People can reach it
A perfect growing site can fail if the intended gardeners cannot reach it often enough to water, weed and harvest.
Sun fits the crops
Six or more hours of direct sun is a common baseline for vegetable gardens. Observe the site during the growing season and verify local crop needs with Extension.
Water is real
Identify the source, owner, meter or account, bill payer, shutoff and how water reaches the farthest growing area.
Materials can arrive
Compost, soil, lumber and mulch need a legal, safe delivery point that does not block accessible routes or neighboring property.
Drainage makes sense
Look for erosion, persistent ponding, runoff entering from roads or neighboring uses, creek flooding and low spots.
The setting supports use
Talk with nearby residents and site users. A garden that fits the surrounding place starts with fewer avoidable conflicts.
Step 3 · Soil safety
A soil test answers only the question it tested.
This is the most important correction to the old guide. A routine garden test may tell you about pH and nutrients. EPA warns that it may not automatically test for environmental contaminants. Start with the property's history, then decide what testing is appropriate.
Site-history procedure
- 1. Verify the parcel and owner. Know exactly which property you are evaluating.
- 2. Research previous uses. Use planning/property records, libraries, historical maps, directories and local agencies where useful.
- 3. Look next door. Nearby industrial, auto, dumping, high-traffic, agricultural or other uses can matter too.
- 4. Walk the property. Note stained soil, oily sheen, tanks or piping, debris, dumping, ash, broken glass and unusual drainage.
- 5. Ask what testing is appropriate. Match the test to the site's history rather than ordering a generic panel and assuming the question is closed.
Fertility test ≠ contaminant test
EPA notes that Extension labs often test pH and plant nutrients, while contaminants such as lead, arsenic, mercury, pesticides or petroleum-related compounds may require a special request, a different laboratory or environmental-regulator guidance. Which contaminants matter depends on the site's history.
Stop here if:
- • site history suggests contamination and nobody has determined what to test;
- • suspicious soil or dumping is present and the team is proposing to cover it without evaluation;
- • test results are concerning and the team is trying to interpret environmental risk without appropriate guidance.
Raised beds are a design tool, not a magic answer
EPA describes above-ground growing, barriers and certified growing media as possible controls in some situations, but the right response depends on the site. Do not assume that putting lumber around imported soil makes a potentially contaminated property safe to disturb. Also note EPA's warning that construction-industry “clean fill” does not automatically mean soil is suitable for food gardening.

Plan for water before beds.
A source is not a water plan until the team knows who controls it, who pays, how it reaches the far end of the garden and what happens when something leaks or freezes.
Municipal or institutional water: confirm permission, meter/account responsibility, shutoff and actual cost.
Well water: verify that the source and capacity are appropriate for the intended use and obtain any locally recommended testing.
Rain capture: treat it as a site-specific supplement unless a real water budget proves otherwise. Check local rules and food-safety guidance.
Flood and runoff check
Water can also bring contamination.
NC State advises against locating edible gardens in floodplains. FDA warns that floodwater can carry sewage, chemicals, heavy metals and pathogens, and produce contacted by contaminated floodwater may be unsafe. Check mapped flood risk, local drainage history and runoff from neighboring properties before investing.
Ordinary rainwater ponding is not automatically the same as a contamination-prone flood. The point is to identify where water comes from and what it can carry.

Ask the local questions before digging.
A national guide cannot tell you whether your fence, shed, compost area, rainwater system, signs or public access require approval in your jurisdiction. Its job is to tell you whom to ask and when.
Planning / zoning
Is community gardening allowed at the parcel? Are there setbacks, parking, hours or land-use restrictions?
Structures
Do fences, sheds, shade structures, signs or water installations require permits or landowner approval?
Water / stormwater
Who approves new water service? Are there floodplain, drainage or rain-capture restrictions?
Compost / waste
What materials are allowed, and how must food scraps, manure, plant waste and trash be managed?
Accessibility
Which federal, state, local or institutional accessibility requirements apply to this public or sponsored site?
Food use
If produce will be sold, donated or served through a school or institution, what additional rules apply?
Call before you dig
Before trenches, irrigation lines, fence posts, deep stakes or other excavation, use 811 or the applicable local utility-locate process. NC State and USDA both include utility locating in garden-site preparation and safety guidance.
811 informationStep 6 · Protect the work
Put the land relationship in writing.
Water lines, fencing, soil, beds and volunteer labor create sunk costs. A handshake does not explain what happens if the property is sold, the garden closes, the water bill changes or the landowner wants the site back.

Planning benchmark
Five years is a useful floor where possible.
NC State Extension recommends negotiating written use for at least five years. Its site-selection handbook describes five to ten years as a useful target. That is not a nationwide legal requirement. It is a reminder that permanent infrastructure is hard to justify on land that can disappear next season.
If the owner offers only short-term use, consider portable beds, containers and low-cost infrastructure, or keep looking for a more secure site.
Insurance: verify the requirement and the coverage
Do not use a generic national cost estimate. Ask the landowner or sponsor what insurance is required, identify any existing organizational coverage, then confirm in writing with the insurer or risk manager whether the garden's actual activities are covered. Budget the real quote.
The same caution applies to liability waivers. Do not copy a sentence from another garden and assume it removes legal responsibility.
Step 7 · Design for real bodies
Accessibility is more than a three-foot path.
Path width matters, but so do surfaces, grades, turning and passing space, gate hardware, reach, bed width and height, water access, seating and the route from parking or transit to the growing area.
Routes
The U.S. Access Board's general accessible-route guidance uses a 36-inch minimum continuous clear width in many settings, with additional space for turns and passing. Verify which rules apply to your site.
Surfaces
Accessible surfaces need to remain firm, stable and slip resistant. Loose material that becomes deep or rutted can defeat an otherwise wide route.
Work area
Choose bed dimensions by reach and working position rather than declaring one universal raised-bed height accessible to everyone.
Public entities, schools, federally funded projects and other sites may have specific legal obligations. Treat this page as a design checklist, not a substitute for the standards that apply to your project.

Step 8 · Draw before buying
Design the operating system on paper.
Plot size is a local choice. Start with movement, water, shared work and future expansion, then fit the beds into the remaining space.
Entrance and routes
Gate, accessible circulation, turning/passing, emergency and maintenance access.
Growing areas
Individual plots, shared beds, accessible beds, children's areas where relevant.
Shared systems
Water, shutoffs, compost, tool storage, bulletin board, waste and washing if provided.
People space
Shade or seating, teaching/gathering area, safe delivery point and room to expand.
Do not install the entire dream in year one. Reserve room for future features, then build only what the first-season team can maintain.
Step 9 · Price the real garden
Separate startup from annual operations.
A donated pile of lumber does not make the garden free. Water, insurance, repairs, tools, replacement soil, accessibility work and administrative costs continue after opening day.

Write the rules in calm weather.
The first gardener should know the same expectations as the twentieth. Rules do not need to be elaborate. They need to be understandable, visible and enforced consistently.
Membership
Eligibility, plot assignment, waitlist, fees and assistance.
Growing
Plot boundaries, trellises, pesticide rules, water, compost and harvest.
Shared work
Paths, common beds, tools, mowing, waste, closing and winterization.
Problems
Abandoned plots, notice, response, accommodation, conflict and urgent safety issues.
Construction
Build only after the gates close.
Construction day should execute a reviewed plan, not discover whether the site is legal, safe or serviceable.

Failure diagnostics
What goes wrong before year two.
One founder does everything
Symptom: every question waits for one person.
Response: document functions, assign backups and stop adding features until responsibility is distributed.
Water becomes the argument
Symptom: hoses, bills and watering schedules create conflict.
Response: meter costs, define access and write the operating rule.
Too much garden, too soon
Symptom: common areas and unused beds turn weedy.
Response: shrink the maintained footprint and reserve expansion for demonstrated demand.
The land relationship is vague
Symptom: nobody knows who owns the fence or who may remove it.
Response: stop new capital work until responsibilities are written.
Accessibility exists only on paper
Symptom: wide paths are loose, muddy, steep or disconnected from beds and water.
Response: evaluate the whole route and work system with actual users.
Opening day outruns the rules
Symptom: plots are assigned before water, pesticide, tool or abandonment rules exist.
Response: pause assignments and establish the minimum operating agreement.
Hard stops
Do not improvise past these questions.
- Land: the owner is uncertain or written permission cannot be obtained.
- Environmental: contamination is suspected or results are concerning and no appropriate authority or qualified professional has closed the question.
- Water: no reliable source has been secured.
- Utilities: excavation is planned before utility locating.
- Permission: required land-use, structure, water, stormwater or sponsor approvals remain unresolved.
- Capacity: the project is materially larger than the people and recurring budget available to maintain it.

Before the first shovel.
How many people do we need?
There is no universal legal minimum. NC State uses at least five committed people as a practical benchmark for a substantial volunteer-led garden. A strong institutional sponsor can change the staffing model.
How long should we control the land?
NC State recommends at least five years where possible. Longer control makes permanent investments easier to justify. Treat that as planning guidance, not national law.
Does a normal soil test prove the site safe?
No. Routine tests often focus on pH and nutrients. Environmental questions may require different testing based on site history.
Do we need raised beds?
Not automatically. They can improve access or allow imported media, but they are not a substitute for investigating a site with suspected contamination.
Do we need insurance?
Requirements vary. Put the insurance question in the land agreement and confirm actual coverage with the sponsor, landowner and insurer or risk manager.
What must happen before digging?
Close permission and safety questions, finalize the layout, and have underground utilities located through 811 or the applicable local process.
